Equipment Rental and Technical Crew Services Terms & Conditions

This document delineates the terms and conditions that govern all rental agreements with Light N Light India Private Limited ("LNLIPL"). Any modifications to these terms are void unless explicitly agreed upon in a written instrument signed by an authorized representative of LNLIPL. The placement of a rental order signifies the Lessee's unconditional acceptance of these terms.

1. Key Definitions

● Equipment: Encompasses all apparatus, accessories, and ancillary items provided by LNLIPL for rental.
● Rental Period: The period commencing upon the Equipment's departure from LNLIPL's premises and concluding upon its official return and check-in by LNLIPL personnel.
● Lessee: The individual or corporate entity that enters into a rental agreement for the Equipment.
● Technical Crew: The trained and qualified personnel supplied by LNLIPL for the express purpose of operating the Equipment.
● Transportation: Refers to the conveyance of Equipment and Technical Crew, the costs of which are invoiced separately.

2. Order Placement and Cancellation

Lessees must maintain an active account. Orders must be formalized via an official Purchase Order. Cancellation fees are assessed based on the first day's rental rate: 50% for cancellations less than 48 hours prior, and 100% for cancellations less than 24 hours prior.

3. Financial Terms

Rates are determined by LNLIPL’s official rate card and are exclusive of taxes. A one-day minimum rental applies. New Lessees must pay upfront. For accounts with credit, payment is due within 30 days. Delinquent accounts are subject to 18% annual interest. A refundable security deposit may be required.

4. Equipment Handling, Usage, and Return

Equipment is supplied in verified working order. The Lessee's signature on the delivery form constitutes acceptance of its condition. The Lessee shall not alter, repair, or sub-lease the Equipment. Operation is exclusively reserved for LNLIPL's Technical Crew. LNLIPL's assessment of damage upon return is final.

5. Equipment Protection, Liability, and Indemnification

The Lessee assumes unconditional liability for the Equipment throughout the Rental Period. The Lessee must either provide a valid certificate of insurance naming LNLIPL as the "Loss Payee," or accept a mandatory, non-refundable Equipment Damage Waiver fee (15% of rental cost), which covers accidental damage only. The Lessee is liable for all repair or replacement costs and agrees to indemnify LNLIPL against all claims and legal expenses arising from the use of the Equipment.

6. Mandatory Provision of Technical Crew

The rental of Equipment is strictly contingent upon the concurrent hiring of LNLIPL's qualified Technical Crew. A standard workday is 12 hours (portal-to-portal). Overtime is billed at 1.5x the rate for the next four hours, and 2x thereafter.

7. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of India. All disputes are subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
